国际刑事管辖权,是指国际社会规定国际犯罪以及追究国际犯罪刑事责任的权力。享有国际刑事管辖权的唯一主体是作为一个整体的国际社会,但国际刑庭、内国法院以及由国际社会与相关国家通过协议成立的混合法庭都可以代表国际社会行使国际刑事管辖权。国际刑事司法实践可以通过并行管辖原则、排他管辖原则和补充管辖原则来分配国际刑庭与内国法院对国际刑事管辖权的行使。

The International Criminal Jurisdiction is a power to stipulate the international crime and to investigate and affix the criminal responsibility of international crime by the international community.The unique subject that enjoys this power is the international community as a whole,but the international criminal tribunals,the domestic criminal courts,and the hybrid tribunals established by the agreement between the international community and related nation can represent the international society and exercise the international criminal jurisdiction over the international crime.According to the international judicial practices,there are three principles of distribution the power between the international criminal tribunals and the domestic criminal courts,i.e.the concurrent jurisdiction,the exclusive jurisdiction,and the complementary jurisdiction.
