作为突发性灾害治理的主体,政府是最具权威的公共机构。政府作为公权的代表,必须在灾害应对中起主导作用,但是政府的职能是有边界的。非营利组织(NPO)在突发性灾害治理中具有行动快速、擅长联合行动、专业性强和工作细致等政府不可比拟的优势,但同时也面临如下困境:首先,我国NPO与政府之间的关系一直以来都未理顺。对NPO来说,现有政策和法律上的缺陷以及政府对NPO的管理模式,是其发展壮大的障碍;在政府看来,NPO的大量存.在是在政府之外树立了新的权威,带来了治理上的困难。这样的认知使双方的合作很困难,双方之间的良性互动更少;其次,没有正式的法律可以保证NPO参与救灾。政府与NPO之间合作关系的规定在法律上有待进一步具体化;此外,还存在政府对NPO的监管不力和NPO自身组织结构不完善等问题。有鉴于此,应采取如下对策:第一,双方改变认知态度;第二,政府出台正式的法律保证NPO参与救灾,畅通与NPO的合作机制;第三,NPO应完善自身组织结构,加强自身能力建设。

Government, the mainstream in abrupt disaster governance, is of high authority. As a public power represent- ative, it must take the lead in disaster response. When compared with the limited capabilities and functions of government, NPO, which are strongly professional, embraces incomparable advantages in immediate, united action, and meticulous work. However, NPO still confront some difficulties as follows.. First, there exists misconception of recognization between government and NPO. Second, there is no official law that can ensure the NPO participation in disaster governance, and government has the obligation to supervise NPO. Therefore, regulations on cooperation of government and NPO need to be crystallized in law. Third, NPO has to improve their organizational structures and enhance their abilities. To deal with these difficulties, we should take the following countermeasures into account. Both sides need to alter their attitudes; government should promulgate formal law to guarantee NPO participation in disaster governance; and NPO should consummate its struc- ture of organization and enforce its capable construction.
