知识产权保护素来是国际投资条约的议题之一。然而,20世纪中期以来,这一保护制度展现出转型发展的趋势。根据制度演变的关键特征,这一转型依循从财产保护到投资保护的转变、特殊保护规则对一般保护规则的递补和投资保护规范与知识产权保护规范的挂钩之理论进路。特别是20世纪90年代以来,伴随着第二次和第三次转型,知识产权保护制度呈现出一体化取向、市场化导向、相符性例外和一致性解释、TRIPS—plus性质和例外条款的复生等显著趋势。我国投资条约在国际投资条约转型发展的整体格局中演变,但是并没有完全复制这一转型发展的全部内容。我们应当跟踪研究这一转型过程中发展出的新制度,并借鉴其中能够为我所用的积极方面。

One issue covered by international investment agreements (IIAs) is intellectual property rights (IPRs) protection. Since mid-20 century, some emerging developments with regard to IPRs have been transfor- ming substantive IIAs. According to their key system characteristics, three clues for Orientating this transforma- tion process have been found, that is, protection gradually evolved from property-based to investment -based systems, special norms supplementary to general norms on investment protection, and linkages between invest- ment protection norms and IPRs protection norms. Especially since 1990s, certain prominent trends have been emerging in IPRs protection systems, particularly an integrated approach, market-based orientation, exceptions to consistency and consistent interpretation, TRIPS-plus nature, and revival of exception clauses. However, their contents are not all be reflected in IIAs concluded by China. We should study the emerging systems con- comitant with this process, and draw lessons from them.
