专利权滥用指专利权人行使专利权却违反了专利权设置之目的的行为。禁止专利权滥用原则可以弥补成文法的不足,对消减专利权的外在范围设置与专利制度推动科技发展的内在价值追求之间的冲突,具有重要的功能价值。但禁止专利权滥用一般性原则的不当使用可能造成对权利的＂滥限＂。对该原则的制度化应从不断完善法律规范对专利权范围界定以及确立禁止专利权滥用一般条款适用的程序这两方面展开,以保障禁止专利权滥用原则更好地实现其功能价值。
專利權濫用指專利權人行使專利權卻違反瞭專利權設置之目的的行為。禁止專利權濫用原則可以瀰補成文法的不足,對消減專利權的外在範圍設置與專利製度推動科技髮展的內在價值追求之間的遲突,具有重要的功能價值。但禁止專利權濫用一般性原則的不噹使用可能造成對權利的＂濫限＂。對該原則的製度化應從不斷完善法律規範對專利權範圍界定以及確立禁止專利權濫用一般條款適用的程序這兩方麵展開,以保障禁止專利權濫用原則更好地實現其功能價值。

Patent right abuse refers to the action that patent owners exercise patent rights in violation of the purpose of patent law.The principle of prohibiting patent right abuse is to limit the right when the exercise of the right deviates from the purpose of the law,thus to make up the defects of the statute law and eliminating the difference between patent right scope and its function of promoting science and technology development.However,the abuse of the general principle of prohibiting patent right abuse might also improperly limit patent right.For the legal system construction of the principle,the scope of patent right should be continuously improved and the procedure of applying the general provision of prohibiting abuse of patent right should be established,so that the principle of prohibiting patent abuse can best achieve its functional goal.
