随着世界多极化、经济全球化和国际法治化向纵深发展,开展法律外交有助于增强我国的硬实力、软实力和巧实力。自改革开放以来,我国对外交往不断取得新成绩。在法律外交领域,我国积极参加联合国、世界贸易组织等国际和区域组织,制定多边和双边条约,将部分外交问题转化为法律问题,有效化解外交纠纷。在民间外交中,中国法学会充分发挥学术外交、法律外交和民间外交的优势,成为我国开展法律外交的先锋践行者。展望未来,我国将以法律外交的方式更进一步参与全球治理,加强开展法律外交的综合实力,巩固法律外交的机制建设,推进法律外交的民间进路,为促进国家总体外交、推动和谐世界的建构做出新贡献。

In a world of ongoing economic globalization and multi-polarization as well as enhancing rule of law,active judicial diplomacy has proven to be conducive to improving the hard power,soft power and smart power of China.Since it started to implement the policy of reform and opening-up to the rest of the world in the late 1970s,China has made steady and remarkable achievements in diplomatic exchanges with the rest of the world.In particular,China has made great strides in judicial diplomacy,actively participating in the United Nations,the World Trade Organization and many other international and regional organizations,engaging in the formulation of numerous multilateral and bilateral treaties and conventions,converting some eligible diplomatic issues into legal issues,and thereby effectively solving many diplomatic disputes and contributing to the improvement of China’s diplomatic environment over the years.Furthermore,in terms of public diplomacy,China Law Society,the leading legal professional association of China,has played a pioneering role in promoting international academic exchanges,judicial diplomacy and other law-related aspects of public diplomacy.In the future,China is expected to enhance its role in global governance through judicial diplomacy,enhance its overall capabilities of judicial diplomacy,consolidate and strengthen its mechanism for judicial diplomacy and actively encourage public or people’s judicial diplomacy,so as to contribute to the overall diplomatic success of the country and harmony of the international community.
