近年中国社会转型，政治、经济体制改革，形成了体育社会关系的许多转变，出现一些新型的体育社会关系，需要体育行政法对新型的体育社会关系做出准确定位和调整。基于上述认识，从我国体育行政法律关系的沿革出发，分析了目前体育行政工作存在的一些问题，解析了新型体育行政法律关系调整的出发点为“公共性”，其价值支点为社会公平和正义。并提出体育行政法律关系调整关键是政府自身职能的定位．而厘清政府、运动项目管理中心、体育市场、公民社会体育界线是问题的重点。

In the recent years, the transformation of the Chinese society, the reform of the political and economic system have changed lots of sports social relations and some newly typed sports administration legal relations have emerged. Therefore, accurate orientation and readjustment of these relations should be set through sports legislation. Publicity and social justice are the basic elements. The governmental functions should be readjusted. Roles of the government, the sports event administration centre, the sports market and sports for all should be further clarified.
