面对经济快速发展背景下海洋环境日益遭受严重污染破坏并造成巨大经济与生态损害的严峻形势，相关民事和行政性法律制度因其自身的特殊性而无法完全满足保护海洋环境以及维护当事人合法权益的需要。基于有效惩治海洋环境犯罪的现实需要，切实履行相关的国际公约义务以及借鉴国际社会强化海洋环境刑法的有益经验，我国亟待加强海洋环境刑事法治。从立法层面看，我国应当完善相关行政法与刑法的顺畅衔接，还需要从完善罪名、明晰罪状以及提高该类罪的刑罚措施的效率等方面改进现行海洋环境刑事立法。

Under the background of rapid economic development, the marine environment has been seriously polluted, thus causing increasingly huge economic and ecological loss. In this situation, the civil law and the administrative law, due to their respective particularities, can not fully meet the needs of protecting the marine environment and safeguarding legitimate rights and interests of the parties involved. China should strengthen the criminal law on marine environment immediately in order to effectively punish the marine environmental crimes, to fulfill China＇s international obligations, and to learn from the benefi- cial experience of the international community. As to the criminal legislation on the marine environment, the key measures should include achieving the smooth cohesion between the criminal law and the administrational law, and perfecting the crimi- nal legislations on the marine environment, such as perfection of the names of crime, clear description of crimes and efficiency of penalty measures.
