农村宅基地等农地使用权流转一直为我国现行法律所禁止。这一起源于计划经济时期的农村土地管理法律制度在现阶段市场经济条件下面临日益严峻的挑战。尽管学术界在我国农地使用权能否流转问题上争议很大,但随着这一法律制度得以支撑的经济基础的丧失、对经济建设阻碍作用的凸现以及法律的公平性遭到质疑,解禁宅基地等农地使用权流转已为大势所趋。我国应当因势利导在正确的立法理念指导下,完善宅基地等农地使用权流转的配套法律机制,在试点的基础上逐步开禁宅基地等农地使用权的流转,科学完善农地使用权流转制度。

Circulation of farmland use right such as homestead land s right of use, has been prohibited by the current law. The legal system of rural land management which originated in the planned econo my period has been increasingly faced serious challenges on the present market economic conditions. Although there are great controversies in the academic circle on whether the farmland right of use can be circulated, homestead and agricultural land use right transfer is to be the trend of the times, as this legal system has lost its economic base, becoming increasingly apparent impediment to economic con struction and its fairness of law has been questioned. China should perfect homestead and agricultural land use right transfer, supported by legal mechanisms with correct guidance of the concept of legisla rive in the light of its general trend and based on the pilot project. It is supposed to gradually lift the ban of homestead land use right transfer, scientifically perfecting the related system.
