Tang and Five Dynasties; state-owned land; transformation of property rights
唐五代时期,国有土地经历着一场产权巨变,也就是由国有向私有方向转化,而这期间既有合法的,也有非法的。合法转化主要是在国家政令许可范围内进行;非法转化则大多不是国家政令许可的。但是本着利益最大化原则,唐后期国家便默许甚至认可这种转化,至五代则明令推动国有向私有转化。
唐五代時期,國有土地經歷著一場產權巨變,也就是由國有嚮私有方嚮轉化,而這期間既有閤法的,也有非法的。閤法轉化主要是在國傢政令許可範圍內進行;非法轉化則大多不是國傢政令許可的。但是本著利益最大化原則,唐後期國傢便默許甚至認可這種轉化,至五代則明令推動國有嚮私有轉化。
당오대시기,국유토지경력착일장산권거변,야취시유국유향사유방향전화,이저기간기유합법적,야유비법적。합법전화주요시재국가정령허가범위내진행;비법전화칙대다불시국가정령허가적。단시본착이익최대화원칙,당후기국가편묵허심지인가저충전화,지오대칙명령추동국유향사유전화。
During the Tang and Five Dynasties, the state land experienced the great changes of ownership, namely, from state to private ownership. There were both legal and illegal transformations. The legal transformation was carried within the range allowed by official decree. However, in line with the principle of maximizing benefits, the government acquiesced this transformation. Till the Five Dynasties, the government decreed to promote ownership from the state-owned to the private.
