以《中华人民共和国旅游法﹙草案﹚》的公布为契机,对旅游法性质问题进行了深入探讨,分别评述了关于旅游法性质的几种观点。法律体系通常应该按照其内在逻辑和功能分为私法、公法两大领域,而社会法这个第三个法域的提出,为以往两大法域所不能涵盖的某些部门法的性质找到了归属。这三个法域每个法域下又涵盖着一些既各自独立又相互关联的法律部门。按照这种法域划分标准,我们所讨论的旅游法性质是独立的法律部门,隶属于社会法法域。这种论断是对法学基本理论的丰富,并为进一步完善《中华人民共和国旅游法》﹙草案﹚提供了学理基础,为建立解决旅游纠纷的多元化机制提供了理论支撑点,为构建和谐的旅游环境、促进我国旅游产业的科学发展提供了新的视角。

With the release of Tourism Law of the People＇s Republic of China（draft）,this article makes an in-depth discussion about the nature of Tourism Law and comments on several views of the nature of Tourism Law respectively.Legal system,according to its-logic and function,is divided into two fields———Private Law and Public Law.However,the proposal of social law——the third field of law——provides the adscription for some of the department laws whose nature could not be covered by the two previous law systems.Each of these three law fields contains some independent but interrelated law departments.According to this standard of classifying law fields,Tourism Law we discussed is an independent law department,subordinate to the field of Social Law.This kind of thesis enriches the basic theory of law,provides theoretical basis for further improvements to the Tourism Law of the People＇s Republic of China（draft）,which offers the theoretical supports for building diverse mechanism of solving tourism disputes,thus supplying a new perspective for promoting the development of tourism industry in our country scientifically.
