英国刑法中的共犯退出是共犯参与制度领域的一项特殊辩护事由，具有免除退出人共犯参与责任的效果。其构成要件为：共犯退出须在实行犯着手实行之前；退出的共犯人必须打消自己的犯罪意念；退出人须将自己退出犯罪的意思明确地通知其他参与人；退出人须有实际退出行为。共犯退出的本质在于撤销共犯先前行为对于实行犯的加功效果。英国刑法上共犯退出的系统理论，能够为完善我国刑法上的共犯责任制度提供一种全新的思维方式或视角。

Accomplice withdrawal is a special defence in English criminal law which could free an accessory from com- plicity liability. The constituent elements for an effective withdraw are as follows： the accessory must abandon before the substantive crime is committed by the perpetrator; and there must be a change of mind on the part of the accessory ; une- quivocal notice must be given to the perpetrator; there exists the act of withdrawal. An effective withdrawal must counter- mand or revoke the effect of what has been done by the accessory before his withdrawal. In this paper, the authors fully study the system of withdrawal in complicity in English criminal theory, could supply a new sight and path for the develop- ment and improvement of the complicity liability in Chinese criminal law.
