在服务外包中，发包方普遍认为商业秘密比其它知识产权形态更为重要。商业秘密的经济价值根源，决定了禁令制度在商业秘密保护中具有不可替代的重要地位。我国修改后的专利法、著作权法、商标法虽然都增设了诉前临时禁令这一制度．但司法实务部门在临时禁令能否适用于服务外包商业秘密保护这一问题上认识不一。因此，构建我国服务外包商业秘密保护临时禁令制度是发展服务外包产业的制度基础。

In service outsourcing, commercial secret is more important than other forms of intellectual property rights, which is generally believed by the outsourcer. The source of economic value of commercial secret determines that the injunction system has an irreplaceable role in the protection of commercial secret. Although the new version of China＇s Patent Law, Copyright Law and Trademark Law have added the system of provisional injunction before litigation, yet, whether judicial departments can apply this system for service outsourcing or not is still an un-unified understanding. Therefore, to build the provisional injunction system of China＇s business secret protection in service outsourcing is the foundation of the development of service outsourcing industry.
