禁止刑法司法解释溯及既往原则，是罪刑法定主义禁止事后法原则在刑法司法解释领域的自然延伸。该原则意味着刑法司法解释不仅具有独立的时间效力，而且在任何情况下，刑法司法解释都应坚持刑法溯及力问题所奉行的从旧兼从轻的立场。这既是罪刑法定主义的必然要求，也是刑法司法解释自身的特点所决定的。从总体上看，我国现行刑法司法解释在溯及力的问题上基本采取了从旧兼从轻的原则，但仍存在一些具体问题，需要在实践的基础上不断予以完善。

The doctrine of retroactivity about criminal law judicial interpretation is a natural extension of the le- principle of crime and punishment. The principle means that the criminal law judicial interpretation has the in- dependent effect in the field of time. And in any case, the criminal law judicial interpretation should adhere to the retroactivity of criminal law and pursue with the old and light position. This is not only the inevitable requirement of the legal principle of judicial interpretation of criminal law, but it is also decided by the characteristics of criminal law judicial interpretation. On the whole, China＇ s current criminal law judicial interpretation has taken the doctrine of observing old laws and new ones when with lighter punishment. But there are still some detailed problems and so the criminal law judicial interpretation need to be perfected based on the practice.
