“明晰产权、分山到户”是集体林权制度改革政策的核心,2011年通过对江西省集体林权制度改革中林权确权情况进行调查。结果表明,江西省林权确权工作进展顺利,主要表现为集体林改中农民主体地位得到进一步确认、林地产权落实到位、农户对家庭林地勘界结果清楚,林权纠纷数量逐步减少、村级组织是林权纠纷调处的基础力量。但同时发现各地林权纠纷现象普遍,有许多新的纠纷出现,纠纷原因复杂且呈现动态性,没有调处的林权纠纷还有两成左右。林权纠纷的主要原因大多是历史遗留下来的,农户对已调解的林权纠纷满意度不高,不满意率占到31%。为此,建议调处工作人员进行相关法律知识的学习和培训,提高山林纠纷调处工作效率和工作效果。以维护林区社会和谐发展。

"Clarifying property rights and distributing mountains to households" is the core policy of col- lective forest right system reform. Investigation and analysis of collective forest right system reform of forest property right in Jiangxi results show that the task of clarifying property rights has been carried on smoothly in Jiangxi. Farmers' position as subjects has been confirmed in collective forest reform with their right to forestry in place. Besides, the number of forest rights disputes is decreasing as farmers are now well informed of the family land demarcation and village organizations have become the foundation of power of forest rights dispute mediation. The study and that about 20 percent of these disputes remain unsettled. The main reason of the for- est rights disputes took place years ago mostly because farmers were not satisfied with the results of the media- tion, accounting for 31 percent of all the disputes. Therefore, it is suggested that mediation work personnel re- ceive training of relevant laws in order to improve the efficiency and effectiveness in mediating forest disputes and promote the harmonious development of the forest community.
