可读性强和情感色彩鲜明是台湾裁判文书言语体式优于大陆裁判文书的两大因素。可读性强具体征显为生动、具体、真实性；情感色彩鲜明具体征显为法官的主观能动性及意态性。台湾裁判文书的可读性是台湾法院审判过程中的当事人主义特质；大陆裁判文书的模式化、超然性等，则表现出大陆法院审判过程中的职权主义特质。
可讀性彊和情感色綵鮮明是檯灣裁判文書言語體式優于大陸裁判文書的兩大因素。可讀性彊具體徵顯為生動、具體、真實性；情感色綵鮮明具體徵顯為法官的主觀能動性及意態性。檯灣裁判文書的可讀性是檯灣法院審判過程中的噹事人主義特質；大陸裁判文書的模式化、超然性等，則錶現齣大陸法院審判過程中的職權主義特質。

The readability and subjectivity are the key factors in Taiwan Court＇s adjudication documents that better than that of mainland, in which vividness, concreteness and factuality are the traits of the readability, while the initiativity and attitude of the Judge are the traits of its subjectivity. The readability and initiative reflect the characteristics that the Taiwan Court serves the party during the trial process. The format and aloof attitude reflect the Ex officio doctrine during the mainland trial process.
