在农村土地承包经营权抵押问题上，立法者采用“二元化”的立法态度，即对以招标、拍卖、协商方式取得的“四荒”农地的抵押是可以的；而以家庭承包方式取得的农地抵押是禁止的。尽管立法者禁止以家庭承包方式取得的农地抵押，但福建三明、宁夏平罗、四川成都等地都在积极探索农地抵押创新模式。农地抵押存在一定的风险，但可通过建立农地评估中介机构、地方政府出台相应激励政策、取得集体组织同意农户抵押的声明、农地登记、签订农地转让合同等制度设计来防范风险。

In the aspect of the9. contractual management right of rural land mortgage, lawmakers adopted ＂dual legislative attitudes＂, that is： getting the contractual management right of ＂four barren＂ land mortgage through bidding, auction, negotiation is allowed; but mortgage of rural land acquired by means of household contract is forbidden. Although lawmakers ban the mortgage of household contractual rural land, but Sanming of Fujian, Pingluo of Ningxia and Chengdu of Sichuan are actively exploring rural land mortgage innovation mode. Rural land mortgage does have certain risk, but systems like the establishment of agricultural land eval- uation agencies, the corresponding incentive policies issued by local government, approval statement of house- hold mortgage from collective organizations, land registration and signing rural land transfer contract can all be designed to prevent the risk.
