尽管新刑事诉讼法最终保留了欺骗为非法取证方法的规定，但其引发的以欺骗方法收集证据是非法取证还是侦查策略运用的争论并未停息。有关欺骗取证社会认知状况的调查表明，在现有法律框架下多数人虽认为欺骗与侦查策略有着合法与否的本质区别，但对具体取证行为属于欺骗还是侦查策略的判断具有较大主观随意性和不确定性。侦查策略的运用具有一定的欺骗性，策略与欺骗应属于交叉而非对立关系。

Though the revised criminal procedure law treats the tricks as the illegal method of collecting evidence, the arguments whether the tricks are the illegal collection of evidence or the investigation strategy have not been ended. The survey on the fraud evidence of social cognition condition shows that deception and investigation strategy are very different in essence under the existing legal framework, but the judgments for most people whether individual evidence collection behavior belongs to cheat or investigative tactics are great subjectivity and uncertainty. Using investigation strategies can be deceptive, the relationship between investigation strategies and tricks should be the cross but not opposed.
