基于国际商业贸易的实际需要,多方当事人合并仲裁制度很有必要存在,主要的疑难问题在于,多方当事人之间基于多个合同发生的争议进行合并仲裁.在缺乏一个多方直接参与的明确仲裁协议的情况下,从仲裁立法、仲裁规则和仲裁协议层面来看,当事人合意推定基础之上的合并仲裁具有合理性.合并仲裁在具体的技术操作层面上,由仲裁机构或仲裁庭决定是否合并仲裁,并就仲裁庭的组成进行指定.当事人各方将合并仲裁的情况固定,或者由仲裁庭进行记录备案,有助于合并仲裁裁决的承认与执行.
