间接正犯是刑法理论中的重要问题之一，我国刑法并无间接正犯概念，但是深入细致地研究间接正犯理论具有深远的理论意义和实践意义。通过对间接正犯的概念及认定的论述和分析，提出关于间接正犯的立法构想，以期对我国刑法理论的完善有所帮助。
