当前，网上仲裁的发展还处于初级阶段，存在很多的问题。面对当前的困局，应采取更加宽容的态度，完善相关法律和制度。对网上仲裁协议的“书面要求”做扩大解释；充分利用现代科技技术，完善网上仲裁程序，增加其安全性和可靠性；增加当事人或仲裁员的自由选择，以更灵活的方式确定网上仲裁地；对于法律适用问题的解决，应该更加注重当事人意思自治原则的应用；而仲裁裁决的执行方面，应采取符合国际商事仲裁发展趋势的态度，制定法规，使网上仲裁裁决的执行更加规范。
