环境监管失职致害应该承担国家赔偿责任，是因为国家负有环境污染侵害危险防止责任，普通民众也高度依赖于国家的环境污染侵害危险管理，因环境监管部门不履行或不适当履行监管职责，致使普通民众的生命、身体、健康等重大权益遭受损害，国家应当承担相应的赔偿责任。环境监管失职国家赔偿责任较之加害者的民事赔偿责任而言应属补充责任。对环境监管失职致害的损害救济，应允许受害人在国家与加害者之间进行选择。如果国家在履行赔偿责任之后，应承认其向加害者追偿的权利。

The reason the State should burden compensation liability which results from dereliction of environmental regulatory responsibility is that the state has the duty to prevent environment hazard, and ordinary people are highly dependent on the state＇s environmental risk management. As environmental authority did not fulfill regulatory responsibilities seriously to prevent or deter life and health damage caused by environmental torts ,the state should bear corresponding compensation liability, and its nature is complementary compared to infringerS. In the process of damage relief,the victims should be allowed to choose a compensator from the state and the infringer, and the state has the right to claim to the inflicter after bearing compensation liability.
