基于刑法对累犯制度的规定而形成的一般累犯概念似乎并不会影响到具体的司法适用，但概念本身也反映着对这一制度基点的认识。虽然对一般累犯的理解进路各不相同，但对一般累犯仍然应该采用属加种差的方式予以认定和处理；而且不能将一般累犯作为混合体来进行界定，不能既认为一般累犯是一种量刑情节，又认为一般累犯是刑罚的适用对象。定义的基点与本质、核心特征等并不完全相同。对于一般累犯来说，其基点应该为其定义所涉及的“属”，也就是将其理解为是一类行为人，还是一种具体状况。根据我国刑法对此问题的规定与具体处理，宜将一般累犯定义的基点确定为“人”。

The definition for the general recidivist, which is defined directly according to Criminal Law, will not affect the application of the regulation, but the concept is one perspective to detect the base point for this objective. Although the ways to define the recidivist is quite different, the formula is as to tell the difference from the whole kind. At the same time, recidivist can not be understood as the combination both as a sentencing circumstance and the criminal punished. The base point of the recidivist is quite different from the nature or core characteristics of the recidivist. As for the definition of the recidivist in criminal law, the base points should be put on the kind that the recidivist belongs to, which ought to either be one kind of criminals in comparison with the non-recidivist or one kind of situation to influence the sentence. According to the exact regulation and application of criminal law in China, the recidivist should be interpreted as one type of criminal.
