高校是事业单位，不是国家行政机关，也不是法律法规授权的组织，更不是行政机关委托的组织。高校与学生的关系为教育法律关系，与学生形成的教育合同具有民事合同性质。高校对学生的管理属于内部行政关系，不具有外部行政法律关系性质，高校开除学生学籍不影响学生的受教育权。因此，高校对学生纪律处分的救济途径依法应当为：学生向学校申诉处理委员会和学校所在地省级教育行政部门提出书面申诉。

A university is neither an institution, nor an organization authorized by laws or regulations, and still less an organization committed by administrative authorities. It is an enterprise where the le- gal relationship between the university and its students is educational and the contract between them is civil. The legal relationship of managing student by a university is not an administrative one because the management is internal. Besides, the student＇ s right to education is not prevented by the expul- sion from university. The remedy for the disciplinary action should be appealed to the Students＇ Com- plaints Settlement Committee and to the provincial Administrative Department of Education.
