限期治理是我国环境法中的一项重要制度。由于1989年《环境保护法》在限期治理的启动、实施和期满后处理等方面的制度设计存在先天缺陷，该制度的实施效果不尽理想，未能充分实现立法预期。2013年《环境保护法修正案（草案二次审议稿）》对限期治理制度做出重大修改，具有明晰适用条件、引入治理计划等进步，但仍存在决定主体不明、实施期限未定、处罚形式单一等不足，宜从明确赋予环境保护行政主管部门限期治理决定权、补充限期治理实施期限规定、增加罚款的处罚方式并提高处罚强度等方面改进。

Deadline governance system is an important system in Chinese Environmental Law. Due to the flaws of articles regarding deadline governance system in Environmental Protection Law enacted in 1989, the system is not effective in practice. Compared with Environmental Protection Law, the Draft Amendment to Environmental Protection Law published in 2013 makes much progress in describing deadline governance system, including clarifying applying conditions and developing treatment plan. However,there are still some unsettled issues. The draft should be improved by clearly providing environmental protection agency＇s authority of decision, adding the time limit of the implementation as well as penalty and so on.
