柔性执法的理论依据在于法律正当性、政府目的论和权利本位。柔性执法对于社会组织监管的价值包括五个方面:对刚性执法的有益补充,提升行政正当性,提高行政效率,实现行政民主,减少行政纠纷。柔性执法在社会组织管理中的作用形式包括行政提示、行政约谈、行政告诫、合作式行政执法、行政指导。

The bases of flexible executive practice include the legitimacy of law, the purpose of government and standard of right. There are five functions for flexible executive practice on society organization supervision, that is, the useful supplement of rigid enforcement, the promotion of administrative legitimacy, the advance of administrative efficiency, the implementation of administrative democracy and the decrease of administrative dispute. In the society organization supervision, flexible executive practice shows administrative hint system, administrative conversation system, administrative admonition system, cooperation executive practice system and administrative guidance system.
