法院与文化的结构紧张是当下司法领域的显著现象，也是个案纷争背后深层的结构问题。脱域性与嵌入性构成法院与文化结构关系的两种理想类型，而当下两者的结构关系却呈现混乱复杂的局面，这是造成结构紧张的原因所在。所以，实现法院与文化的良好沟通，就需要在两者的互动过程中，使法院运作得以最大程度地承载文化的价值，从而逐渐形塑一种因应中国社会的法院与文化的稳定结构关系。

The structural strain between the court and culture is a significant phenomenon in judicial field, and also a structural problem behind the individual cases. The disembedding and embedding constitute two ideal types of structural relationship between the court and culture,but the relationship between them is disordered in present, which is a reason for structural strain. If we want to realize a fine communication between the court and culture, we need to make the court operations carry the value of culture, thus forming a stable structural relationship between them which accords with Chinese society.
