当前,我国环境污染问题的日益加剧、环境纠纷的不断增加以及现行环境纠纷解决机制的失效催生了生态审判庭,但其在运行中仍存在诸多问题,专门环境诉讼机制的缺失是重要原因.本文尝试对环境诉讼的诉讼类型加以厘定,并在分析生态审判庭运行问题的基础上,探讨建构我国环境诉讼机制的路径.

With the deepening of environmental pollution and ecological problems and the increasing of the environmental entanglements, especially the frequent occurrence of serious environmental pollution events and the failure of the current environmental dispute settlement, ecological courts appear on the scene. However, there are still many controversies in practice. One of the important reasons is the lack of the environmental litigation mechanism. The article tries to analyze the type of environmental litigation mechanism, and discussing the methods to improving it on the basement of analyzing the problems in operation of the ecological court.
