家庭农场作为一种新型经营主体，具有独立的法律主体地位。对部分省市调研所获得的统计数据显示，家庭农场在工商注册中登记为个体工商户的比例最大。但根据家庭农场的基本特征、发展趋势和政策导向，将家庭农场定位于个人独资企业、合伙企业和公司更符合其本质属性。国内许多省市制定了本地区家庭农场的认定标准，条件各异，建议将经营者主体资格、经营范围、经营规模及土地承包经营权取得条件列为家庭农场设立的法定条件，应基于规模经济效益来测算各地区家庭农场的适度规模。无须对家庭农场的雇工人数和注册资金设置特别的限制条件。

Family farm which has an independent legal status is a new type of business entity. It is better to po- sition family farm as an individual solely invested enterprise, partnership enterprises or company. The qualifica- tion of business entity, scope of business, scale of operation and the qualification of land use rights should be considered as the statutory requirement of family farm. Furthermore, the scale of family farm operation in differ- ent regions should be based on their economies of scale. In capital should not be the qualification of family farms addition, the number of employees and registered capital should not be the qualification of family farms.
