国际能源法以国际能源合作为核心，以新型国际能源社会关系为调整对象，以条约和合同为主要调整手段，是经济全球化背景下国际经济法在能源领域的新内容，既拓展了国际经济法的研究和应用领域，又丰富了国际经济法的内容与体系。将国际能源法简单地归为国际公法的一个新分支或新设为一个独立的国际法部门，显然是囿于对大国际公法的偏爱或对于国际经济法已成为一个独立法学学科的漠视。国际能源法所调整的特定社会关系的经济性、国际性、综合性及调整手段的法律性等主要特征，充分证明其应成为国际经济法的一个新分支。

International energy law is a fresh ingredient in the sector of energy of international economic law under the background of economic globalization. It has international energy cooperation as its focus, a new type of energy-related inter-national social relations as its adjustment object, and contracts and treaties as its principal adjustment means. It has expand- ed not only the study scope of international economic law but also enriched the contents and system of national energy laws of different states. It is owing to the partiality for public international law or the indifference to international economic law that classifies the international energy law into public international law or an independent discipline. The social relations that the international energy law adjusts captures the outstanding characteristics of being economic, international and comprehensive; and the adjusting means or methods that the international energy law applies is regulative. All the above factors, therefore, prove that the international energy law should be a new member of the international economic law family.
