劳务输出劳动争议的处理对劳动者一方存在诸多不利因素,国内省际劳务输出劳动争议的处理存在地方保护主义,而对外劳务输出则因法律环境的变化,劳动者维权更加艰难.国内劳务输出引发的劳动争议适用国内法,但存在程序拖沓及非正式程序流于形式等问题,而外派劳务人员则因缺少明确的立法指导和专业人才的支持,陷于告状无门的境地.出现上述问题既有立法因素,也有劳务输出市场监管因素.因此,必须完善我国劳动立法,统一法律用语并增加劳务外派规定,对非正式程序解决劳务输出劳动争议做出合理设计.发挥行业组织和工会的作用,构建多层次调解网络,提高调解效率.同时建立多方协调保护机制,并加强对劳务外派企业的监督和管理,动员各方资源为劳务输出者提供程序上的保护.

Treatment of labor dispute in labor output conducts many unfavorable factors to one party of labor ers. For example, there is local protectionism in handling labor output dispute between provinces. But, it is more harder to protect laborers'rights while law condition changed during labor output. Domestic law is availa ble to labor dispute caused by domestic labor output, and there are also problems, such as redundant process and informal formalistic process. For lack of clear legislative guidance and talents support, overseas personnel of labor service failed to complain by law. Legislation and market supervision seem the causes. Therefore, we should improve our labor legislation, unify law terms and increase regulations of overseas labor service, and make rational layout for treating dispute by informal process. The role of industrial organization and worker u nion should bring into full play to build mediation network in many levels and increase the efficiency of this work. Coordinated protection mechanism should be formed to enhance the supervision and management of la borexport enterprises, and all parts of resources ought to protect laborers" rights in process and program.
