我国立法机构对＂专家辅助人＂制度的诉讼功能缺乏足够且清醒的认识。借助于首例实践的具体分析认为在直接功能上,该制度有可能减少法官对鉴定意见的误判,但不能保证鉴定意见的正确判断;在间接功能上,可以揭露个案鉴定意见中的问题,但不能保障鉴定质量的普遍提高。而且,该制度能够轻易挑起专业领域内的分歧,诱发＂重复鉴定＂,进而产生有损于司法效率的负面功能。

With the system of ＂expert advisor＂, China ＂s legislative bodies lacks sufficient and a clear understanding. With the first judicial case of specific analysis, this paper argues that, in the direct function, the system may reduce the miscarriage of justice of the expert evidence, but cannot guarantee the correct judgment; in the indirect function, the system could expose the problem of the expert evidence, but cannot improve the quality of expert evidence. Moreover, the system can easily stir up divisions within the professional field, induced ＂duplicate expertise＂,thus, its damage to the negative function of judicial efficiency.
