敦促政府在法律的限度内进行善良行政是人们的共同追求,不过,不同的国家对于如何实现行政法治则进行了不同的探索,进而分别采取了不同的解决方案。法国和德国尽管同样采用了行政法院制度,但是在制度的设计方面存在诸多不同,而在这不同的背后又有着某种共同的趋势。对于这些异同以及背后的种种机缘的分析和借鉴,无疑将会有助于我国行政法治的发展以及今后行政法院的建立。

Urging the government to carry out the good administration within the limits of the law is the common pursuit of people. But, different countries on how to realize the rule of administrative law have different exploration, and then take different solutions. France and Germany, despite using the same administrative court system, but there are many differences in the design of the system, and behind the different that there are some common trends. Analysis and reference of these similarities and difference as well as behinded opportunities ,will undoubtedly contribute to the development of administrative law in China and the establishment of administrative court in the future.
