当前,专利竞争形态已经从传统的军备竞赛发展到专利市场的力量角逐.专利中间商基于不同动机,在专利市场上创造出各种新型的运营模式,一定程度上促进或阻碍了专利法宗旨的实现.专利经纪通过促进交易和提升价值来激励创新,进攻性专利聚合呈现出阻碍或者破坏专利市场的表现,防御性专利聚合有助于降低诉讼威胁,也可能通过串通价格对抗外在竞争者而形成垄断.各国基于不同发展阶段所作出的政策选择,使得专利中间商的运营与专利制度的宗旨保持一致性.

Currently, competitive form of patent has developed from the traditional patent-arms race to patent market forces. In the pa- tent market, patent intermediaries, based on different motives, create a variety of new business models, which promote or hinder the realization of the purpose of patent law to some extent. Patent brokerage promotes innovative activities through boosting transactions and enhancing value. Offensive patent aggregation shows to hinder or undermine the patent market performance. Defensive patent aggregation can help to reduce the threat of litigation, but it also has the possibility to form monopolies through price collusion against external com- petitors. Countries can make choice of policies based on different development stages, in order to consist patent intermediaries with pa- tent system.
