对CSSCI法学来源期刊诸民法论文的域外文献进行分析,可以发现,我国民法学者在撰写论文时存在着引证域外文献偏好,甚至有发展成“无洋不成文”的研究格局的趋势.这种引证偏好可以从一个侧面反映民法学研究中制度路径的竞争和选择.在制度路径的竞争过程中,学者们会逐渐形成对大陆法系或英美法系的路径依赖,过度的路径依赖会贻误本土民法学的培育.

To analyze foreign references citations of civil law papers collected in CSSCI journals （Law class）, we could discover that Chinese civil law scholars had the preference of citing foreign references, which even led to formulating the trend of developing into a research pattern of ＂no foreign references, no papers＂ . According to this citation preference, we can find the competition and choice of system path in the civil law researches fi＇om one aspect. In the process of path competition, the scholars will gradually formulate the path dependence of the civil law system or common law system. Once the path dependence becomes excessive, it will do harm to the cultivation of native civil law.
