司法权在体育纠纷中的边界之厘清，既关乎法治原则与体育自治原则在体育领域的关系，也关乎体育领域纠纷的公正、有序、及时解决，以及体育组织权力的保障和体育人权利的救济。现有研究尚无法提供能够真正消解理论争论、解决实践混乱及隐藏于其背后的困惑之理论思路。因此，厘清司法权在体育纠纷中的边界，是迫切需要体育法学破解的一个重大理论和实践问题。采用文献资料等研究方法，在对体育纠纷进行精细化划分的基础上，界分了体育法律纠纷与体育非法律纠纷，根据不同性质的体育纠纷确定了体育自治权与司法权的范围；通过对体育自治原则与司法终局原则关系的分析，进一步从理论上论证了司法权在体育纠纷中的边界，进而提出了司法介入体育纠纷的一般条件，为解决这一重大理论和实践问题提供了路径。

To clarify the boundary of judicial power in sports dispute is not only pertains principles of rule of law and sports autonomy, but also influence to solve sports legal dispute justly, orderly and timely and to protect right of sports organization and sportsman. The current researches still have not provided a method to solve the ideological argument and practical disorder. Therefore, to clarify jurisdiction boundary in sports dispute has theoretical and practical significance. Based on a detailed classification of sports disputes, this paper distinguishes sports legal dispute and non-legal dispute, and definite the area of sports autonomy and judicial power in sports dispute. By an- alyzing the relationship between the principle of sports autonomy and the principle of judicial final settlement, further theologically expounds and proves the boundary of judicial power in sports dispute, and then put forward gen- eral conditions for judicial interventions in sports dispute.
