行政裁量权是一个现代概念,在现代法学研究和公共行政研究中先后得到理论确认.在19世纪和20世纪这段历史时期内,从理论研究中可以科学/法律规范与伦理规范的分化,伦理规范逐渐凸显出来,这层分化一般也用于解释权力行使过程中伦理规范生成的逻辑.然而几种规范分化的背后涉及到的是权力本身在近代社会中的分化,即权力分化客观上造就了行政伦理.但是这并不能说明行政伦理根源于权力二元分化,而是权力的二元分化造就了近代理论研究中科学/法律规范与伦理规范并立的客观结构,即二元结构给行政伦理提供了外在的规范空间.

Administrative discretion is a modern concept, which has been confirmed in modern legal research and public administration research. In the 19th and 20th century, there was a differentiation between scientif- ic/legal norms and ethical norms from the theory and ethical norms had gradually made prominent. This process of differentiation has been generally used to explain the generation of ethical norms in exercise of pow- er. However, behind the differentiation of several norms involves the differentiation of power itself in modern society, namely the division of power that created administrative ethics. But it does not explain the powers of administrative ethics rooting in the differentiation of power. It just created the modern theory of the objective differentiation of scientific/legal norms and ethical lCS norms, and provided extrinsic space for administrative ethics.
