调解机制的中立性、保密性、灵活性等特性使其在非物质文化遗产跨国争议的解决中具有明显的优势。在实践中已有过多起成功运用调解机制解决非物质文化遗产跨国争议的案例。目前现有的国内、国际调解机制对于解决非物质文化遗产的跨国争议总体上是有效的,但也存在一些不适应方面。有必要从建立专门调解机构、健全调解规则等方面对其加以完善。

The mediation mechanism is obviously advantageous in settling transnational disputes of intangible cultural heritage due to its neutrality, confidentiality and flexibility. At present, there are several successful cases of resolving transnational disputes of intangible cultural heritage by application of mediation mechanism. In general, the existing domestic and international mediation mechanisms are effective in resolving such disputes. However, they are not suitable in some respects. Therefore, it is necessary to improve the mediation resolution mechanism by establishing specialized mediation agencies and improving mediation rules.
