《侵权责任法》第59条出身于我国“医药不分家”的医疗体制,它过于注重医疗机构“销售”医疗产品这一表征,而没有对医疗服务区别于商品销售的特性给予充分考虑.在医药尚未分离的时代,第59条具有存留价值.在医疗机构走向“医药分家”的进程中,与其狭隘地、机械地、不加区分地适用第59条从而将其演化为旧体制的“固化剂”,不如全面地、辩证地分析医疗机构的责任归属、使其细微地反映不同情形,将第59条演变为新体制产生和建立的“压力阀”和“推动器”.可通过类型化处理方式,比如医疗机构的类型化、服务商品区分的类型化、产品缺陷的类型化、医疗产品的类型化和与医疗产品有关的责任类型化,来缓解第59条对医疗服务提供者所带来的负面影响.

Article 59 of Tort Liability Law was born in a context where provision of health service is not separated from sale of medical products. It gives too much emphasis to the fact that medical institutions are involved in the affair of selling goods, lacking full consideration of the distinct nature of health care. In an era when provision of health service is still integrated with sale of medical products, there is room for Article 59. There is a need to view Article 59 in a context, to differentiate circumstances, and to transform Article 59 into a vehicle of promoting new health care reform, rather than applying it mechanically and uncritically and making it become an obstacle to new reform. There is also a need to categorize several key factors, such as medical institutions, service-goods dichotomy, defects of products, medical products and liabilities relating to medical products, in order to alleviate the negative impacts that Article 59 has exerted on medical institutions.
