自20世纪中期以来，伴随着传统社会的变迁及家庭结构的瓦解，法律与家庭的互动也有了新的发展，家事纠纷数量激增。目前我国尚未形成独立的家事诉讼制度，司法实践中对家事特别程序的探索尚属于起步阶段。从长远来看，基于家事纠纷的特殊性和既有审判制度的局限性，我国有必要构建独立的家事诉讼特别程序，以儿童最大利益为导向，实行有限的辩论主义和积极的职权主义，并对立法模式、适用范围、诉讼主体、家事调解以及家事法院等方面作出规定。

Since the middle of the 20th century, along with the changes of societal traditions and the collapse of tradi- tional family structures,interactions between the law and the family have been developing in a new direction with a surge of family disputes. Currently, China has not yet formulated an independent family litigation system and the judicial practice in special procedures for family disputes is still at a preliminary, exploratory stage. This paper argues that, given the particular- ity of family disputes and the limitations of the existing justice system, it is necessary, in the long run, for China to establish a special procedure for family litigation. The special procedure for family litigation should be oriented in the best interests of children, implement the limited adversary system and active inquisitorial system, and make specialized provisions for such aspects as legislative mode, scope of application, subject of litigation ,family mediation and family courts.
