在关于法律本质的认识、比较法学的追求目标和研究方法之间存在着一种内在联系,它们共同构成比较法学的研究范式。后者是学术大气候的产物,带有明显的以非法律学科为导向的色彩。以比较法学研究范式的动态变化为线索,可以发现,在该学科的发展史上始终贯穿着一条清晰的反法条主义进路:首先,概念法学和法律实证主义联手形成的极端形式主义传统成为这条进路的起点;其次,为了谋求专业化和独立学科的地位,比较法学者先后以社会学和人文学科为导向发起两次反法条主义运动。这条进路日益突出了比较法学作为一门理论性学科的维度,而减弱了它作为一门实践性学科的特质,结果造成该学科在理论和实践之间出现分裂。

There is an inherent relationship among the epistemic views concerning the essence of law, the main purposes and methods of comparative legal studies. These factors constitute the research paradigm of the discipline of comparative law, which, as a result of broader academic context, is obviously oriented by non-legal disciplines. Looked from the sequence of the dynamic changes of the research paradigm, there is a clear anti-legalism approach that runs throughout the development of comparative law. First, Begriffsjurisprudenz and Legal Positivism together formed the extreme tendency of legal formalism, which was the starting point of the anti-legalism approach. Second, in order to achieve a high degree of specialization and establish comparative law as an independent discipline, comparatists have launched two anti-legalism movements which were respectively guided by sociology and humanistic disciplines. Under the action of the anti-legalism approach, comparative law transformed incrementally more into a theoretically oriented academic practice, and lost its utilitarian character of being practical knowledge, and resulted in the dichotomous great divide between theory and practice.
