服务贸易紧急保障机制的构建是区域服务贸易自由化进程中一个具备典型的“GATS＋”特征的制度创新因素。文章首先对区域服务贸易紧急保障机制的主要特征进行分析，然后重点论述在区域服务贸易紧急保障机制的构建过程中存在的三大焦点争议：紧急保障机制在立法模式上的“水平模式”或“部门模式”之争，“国内产业”界定的“地域”标准或“国籍”标准之争以及损害量化中的“标准选择”和“举证数据来源”之争。在此基础上，文章指出中国对外构建的区域服务贸易紧急保障机制呈现出“虚”、“实”兼具但“实”而不详的问题并提出了政策建议。

The construction of emergency safeguard mechanism is a typical ＂ GATS ＋＂ institutional innovation factor in the process of regional service trade liberalization. This paper firstly analyzes the main features of emergency safeguard mechanism of regional service trade, then focuses on three controversies in the process of building service trade emergency safeguard mechanism： the choice of ＂horizontal mode＂ or ＂sector mode＂ in the legislative mode of emergency safeguard mechanism, the definition of ＂domestic industry＂ by ＂location＂ or ＂nationality＂, and the dispute in ＂standards＂ and ＂data sources＂ in damage quantization. On this basis, it points out the problems in China＇s service emergency safeguard mechanism, for instance, the provisions are ＂existed＂ but ＂not detailed＂, and also puts forward a series of corresponding policy recommendations.
