由国家民委倡议发起、国务院多个部委共同参与的兴边富民行动，既是事关振兴边疆、富裕边民的事情，更是事关全国建设的大局，其法政策学上的正当性，在于补偿机制下的平等发展权。平等发展权对于研究民族区域经济和民族经济的失衡具有较强的解释力。兴边富民行动本身内涵丰富，涉及民族、政治、经济、文化等诸多方面，但是，如果法治这一方面残缺，甚至缺席，则必然会危及整个行动的正当性和可行性。本文结合法学理论、法律教义和调研成果，提出应当通过严格执法、配套修法和适当立法。建立兴边富民行动长效的法律保障机制，以保障基本的公平，降低权力寻租的空间和提高效率。

The Action of Prospering Frontier sponsored by the State Ethnic Affairs Commission with participation of several ministries and commissions of the State Council concerns not only to vitalize border areas and to enrich the people living there, but also the construction of the whole country. From the view of legal politics, the justification of this action is based on the equal fight to development under compensation mechanism. The equal fight to development provides a powerful explanation to the study of the imbalance of ethnic economy and minority regional economy. The connotation of Action of Prospering Frontier is rich, in- volving aspects of ethnic minority, politics, economy, and culture. However, the justification and feasibility of the entire action must be affected if the legal system is ring to the theoretical approaches of law, law articles and a long- term efficient legal mechanism through strict law propriate legislation in order to ensure the basic fairness, in deformity or even absent. Therefore, by refer- investigation results, this article proposes to build enforcement, matched legal modification and ap- to reduce the probability of power rent - seeking, and to raise efficiency.
