跨流域调水是复杂的系统工程，协调调水沿线不同利益主体之间关系的焦点问题是生态补偿。生态补偿不仅要得到国家政策支持，而且有赖于法律的权威性、稳定性，切实保障生态公平与社会正义实现。跨流域调水生态补偿法律制度建设，应积极确认和引导不同类型补偿主体出现，受水区企业、社会组织及自然人都可以成为补偿主体；受偿主体不但可以是作为国家、社会组织和自然人的“人”，也可以是生态环境；生态补偿标准暂不宜在国家层面作相关立法规定，但应明确其法定要素；健全生态补偿监督机制，应强化国家监督的作用，并发挥社会监督的有效性。
