在我国学界,对于机械表演权的国内法依据和国际法依据一直存有争论,而现行《著作权法》规定的表演权定义过于宽泛,造成其在控制范围上与放映权、广播权、信息网络传播权存在交叉重合,正在修订的《著作权法（草案）》3个稿本都未解决此问题,因此建议以“现场性”统辖表演权和放映权,并以此区别于广播权和信息网络传播权,形成界限分明、简洁易懂和逻辑合理的传播权体系.

The domestic legal sources and international legal sources of the right of mechanical performance have puzzled the Chinese academics for a long time. According to the Copyright Law, the definition of the right of mechanical performance is to abstract and it is easy to be coincided with the right of showing, the right of broadcast and the right of communication of information on networks. What＇s more, the three drafts of the third revision of the Copyright Law did not solve the problem. In order to solve the problem, this paper proposes that the right of performance and the right of showing should be combined by ＂live＂ condition to distinguish them from the right of broadcast and the right of communication of information on networks, and finally to establish a concise and reasonable communication right system.
