登记是不动产物权变动的要件，没有登记则不发生不动产物权变动的效果。在不动产交易活动中，基于双方申请原则，当交易一方因其利益考虑而拒绝或怠于履行登记义务时，相对方就不能实现其预定的物权效果，只能请求登记义务人协助登记，但我国法律没有规定不动产登记请求权。登记请求权与物权变动密切相关，旨在请求义务人协助不动产登记，属于一种民事实体权利；登记申请属于一种启动不动产登记的程序性权利，需要厘清两者的区别。不动产登记请求权具有体现意思自治与维护交易安全的价值，有其法定和当事人约定的根源，我国立法应当规定登记请求权制度，并应对登记请求权制度进行规范，从而为司法实践提供法律适用。
