传统国际贸易理论通常把贸易协定视为完全的，WTO争端解决机构应当仅是扮演一种纯粹的执行角色。但在现实中，契约是不完全的，大多WTO中的贸易争端不只是涉及执行明确规定的义务，还涉及模糊条款的解释，或协定文本空白的情形。这是”默认规则”得以适用的主要原因。WTO争端解决机构在对贸易争端进行裁决时，应注意区分“多数的默认规则”与“惩罚性默认规则”。

Generally, traditional theories of international trade typically views trade agreements as complete and pure role of enforcement in WTO＇s Dispute Settlement. In real situation, however, contracts are incomplete and most trade disputes in the WTO concern not merely the enforcement of the clearlyspecified obligations, but the interpretation of vague provisions, or of instances in which the text of the agreement is silent. This is why ＂default rules＂ should be applied in the WTO dispute settlement process. The WTO＇s Dispute Settlement Body should make a distinction between majoritarian default rules and penalty default rules when making decisions on trade disputes.
