知识产权扩张的自然权利理论逻辑陷入循环论证：“因为有经济利益，所以要有权利保护”，还是“因为有权利保护，所以才有经济利益”呢？功利主义的逻辑是：因为不扩张知识产权就无法激励知识成果的产出，所以要给予相应的扩张。知识产权的扩张史，总体上说是功利主义战胜自然权利理论、功利主义抑制知识产权的自然权利式扩张冲动的历史。我国学术界提出的知识产权法定主义其实是功利主义的一种简化，如何实现从权利到功利的知识产权扩张逻辑转换，仍有待深入研究。

The logic of natural rights theory in demonstrating the expansion of intellectual property right is circular： either IP right should be protected because of its economic interests or the economic interests of IP originated from the protection of it？ However, according to the logic of utilitarianism, if IP right is not be protected, there would not be adequate incentive to produce knowledge outputs, so the expansion of 1P right is reasonable. Generally speaking, the history of the expansion oflP right is a progress of utilitarianism overcoming naturalism. Legalism is just another simple mode of utilitarianism in interpreting the expansion of IP right in China. Therefor, we still have much to do to realize the logical shift from right to utility of intellectual property right in China.
