转化犯是真正身份犯。在聚众斗殴过程中出现致人伤亡但无法查清行为人情形的，应当根据行为人事前对伤亡结果的心理态度确定是否构成转化犯罪及其责任范围；集团犯罪转化犯的责任范围应当根据行为人事前对暴力、胁迫行为的心理态度来确定。间接正犯的转化犯要根据利用者对法定结果的心理态度和被利用者刑事责任能力的状态来确定；共谋共同正犯转化犯的责任范围应当根据共谋的内容是否包括转化犯罪来确定；承继性共同正犯转化犯的责任范围应当根据后参与者参加犯罪的时间来确定。在共同犯罪的转化犯与结果加重犯竞合的情况下，需要根据转化犯罪的性质来确定转化犯的责任范围；在共同犯罪的转化犯与包容犯发生竞合的情况下，应当根据行为人的行为状态来确定转化犯的责任范围。
轉化犯是真正身份犯。在聚衆鬥毆過程中齣現緻人傷亡但無法查清行為人情形的，應噹根據行為人事前對傷亡結果的心理態度確定是否構成轉化犯罪及其責任範圍；集糰犯罪轉化犯的責任範圍應噹根據行為人事前對暴力、脅迫行為的心理態度來確定。間接正犯的轉化犯要根據利用者對法定結果的心理態度和被利用者刑事責任能力的狀態來確定；共謀共同正犯轉化犯的責任範圍應噹根據共謀的內容是否包括轉化犯罪來確定；承繼性共同正犯轉化犯的責任範圍應噹根據後參與者參加犯罪的時間來確定。在共同犯罪的轉化犯與結果加重犯競閤的情況下，需要根據轉化犯罪的性質來確定轉化犯的責任範圍；在共同犯罪的轉化犯與包容犯髮生競閤的情況下，應噹根據行為人的行為狀態來確定轉化犯的責任範圍。

The transformational offense is a standard status -related crime. Occurred in affray which caused casualties but actors could not be identified, the behavior should be judged by whether it constitutes transformational offense and limitation of liability on the ground of mental attitude. The responsibility of the transformational offense in organized crimes should be judged on the ground of the attitude towards violence and coercion beforehand. The judgement to the transformed in the indirect accomplice should be made on the ground of the mental attitude towards legal results of the use and he crimi- nal capacity of the used. The legal liability of plotting co - principals which has transformed should be confirmed on the ground of the judgement that whether the complicity has contained the transformed commit. As to the successive accomplice perpetrator, the legal liability should be made on the ground of the time the latter participate in. Under the circumstances that the competition between the transformed and consequential offense, the responsibility of the transformed needs to be de- fined while considering the nature of the transformed, e. g whoever unlawfully detain another causing the death, it is still possible to constitute the crime of willful ; In the case that the competition between the transformed of common crime and absorbable offense, it is true that the state of the actor when he implemented the act should be considered to judge the limita- tion of his liability.
