竞技体育的不断发展使其与侵权法等各个法律部门之间的联系愈发密切，竞技体育运动所具有的特殊性迫切要求对竞技体育的概念在法律层面上进行界定。中国目前对竞技体育的概念还没有具体的成文法规定，这已不能适应国内体育事业的发展现状。美国在该方面已有了相当的立法与司法实践，其经验从正反两个侧面表明，竞技体育概念和结构的细化应以使得法律在实施上具有可操作性为基本原则，这为我国竞技体育法律概念的完善带来了启示，即既要明确其构成要素和精神内涵，还要对其进行适当分类。

As competitive sports are developing, the relationship between competitive sports and laws, such as tort law, is getting closer. The particularity of competitive sport requires that the concept of competitive sports should be defined from the legal perspective. However, there is no specific statute law concerning the concept of competitive sports in China, which cannot meet the needs of sports development. Comparatively speaking, the U. S. has undertaken legislative and judicial practice in this regard, which proves that the defining and categorization of competitive sports by law is feasible.
