文化政策法治化是当前我国文化法制建设的重要面向，应当以宪法上文化权利的实现为依归。我国宪法上的文化权利可以概括为文化表现权、文化保障权、文化平等权、文化参与权，它们之间相辅相成，从不同的路径引领着文化政策法治化的过程。文化政策法治化应以文化表现权的践行为前提，以文化保障权的满足为内容，以文化参与权的落实为手段，以文化平等权的维护为追求，最终确保宪法上文化权利的完满实现。
문화정책법치화시당전아국문화법제건설적중요면향，응당이헌법상문화권리적실현위의귀。아국헌법상적문화권리가이개괄위문화표현권、문화보장권、문화평등권、문화삼여권，타문지간상보상성，종불동적로경인령착문화정책법치화적과정。문화정책법치화응이문화표현권적천행위전제，이문화보장권적만족위내용，이문화삼여권적락실위수단，이문화평등권적유호위추구，최종학보헌법상문화권리적완만실현。
The constitutional culture rights should be the purpose of the legalization of culture policies which is the important aspect of the legal construction of culture in China ＇s current situation. The constitutional culture rights contain cultural performance rights, cultural guarantee？ rights, cultural equality rights and cultural participation rights which supplement each other and lead the process of the legalization of culture policies in various paths. In order to finally achieve the realization of the constitutional culture rights, the legalization of culture policies should be on the premise of practicing cultural performance rights, for the content of satisfying cultural guarantee？ rights, by means of the implement of cultural equality rights and for the pursuit of the protection of cultural participation rights.
